Disclosure statement regarding the Processing of Personal Data (Articles 13 and 14 of Regulation (EU) 679/2016) for the website www.zecchetti.it owned by Zecchetti S.r.l.

This statement sets out Zecchetti S.r.l.’s confidentiality policies for Personal Data and aims to accurately describe how the Personal Data of portal Users is processed and managed.

This statement does not apply to other websites that might be accessible through hyperlinks on this website. 

MAIN DEFINITIONS

Personal Data: any information relating to an identified or identifiable natural person (“Data Subject“); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing: any operation or set of operations performed on Personal Data or sets of Personal Data, by automatic means or otherwise, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Usage Data: information automatically collected by this Application (or by third-party applications used by this Application), including IP addresses or domain names of the computers used by Users who access this Application, addresses in URI (Uniform Resource Identifier) notation, times of requests, methods used to submit requests to the server, the size of files obtained in response, numerical codes indicating the status of server responses (successful, error, etc.), countries of origin, characteristics of the browsers and operating systems used by visitors, the temporal features of visits (e.g. time spent on each page) and details of paths followed within the Application, with particular reference to the sequence of pages consulted, operating system parameters, and computer environments of the Users.

User: an individual who uses the services of this website, even if only for the purpose of web browsing (corresponds to the Data Subject).

Data Subject: a natural person to whom the Personal Data refer.

Data Controller: the natural or legal person, public authority, agency or other body which singly or jointly with others determines the purposes and means of processing Personal Data. When the purposes and means of such Processing are determined by EU or Member State law, the Data Controller, or the specific criteria applicable for designation of the same, may be determined by Union or Member State law.

This Application or Platform or Website: the hardware or software instrument through which the Personal Data of Users is collected.

No. 00247650351 – Business Activities Index no. 120763 of the Chamber of Commerce of Reggio Emilia, in its capacity as Data Controller of your Personal Data, pursuant to Regulation (EU) 679/2016 on the “protection of individuals with regard to the Processing of Personal Data and on the free movement of such data”, hereby informs you that the Processing of your data will be based on principles of correctness, lawfulness, transparency, and protection of your privacy and rights. 

  1. REPRESENTATIVE OF THE DATA CONTROLLER

There is no provision for a representative of the Data Controller within this Organisation, as this is not required under the regulations.

  1. DATA PROTECTION OFFICER

There is no Data Protection Officer (DPO) within this Organisation as this is not required under the regulations. 

  1. PURPOSES OF DATA PROCESSING

There are various purposes for the Processing of your Personal Data but all are intended to meet your needs and will be implemented only with your free consent.

Specifically:

  1. CONTACTS’ page: requesting information on new products and/or services by sending an email to one of the email addresses listed, or by completing the contact form, along with the possibility of subscribing to the newsletter of the Organisation in order to receive information by email and/or telephone regarding new products and/or services.

You are reminded that the optional, explicit, and voluntary sending of electronic mail to the addresses indicated on the website or, for example, using the ‘CONTACTS’ service, implicitly entails subsequent acquisition of Personal Data. Users are therefore requested not to send names or other Personal Data of third parties in applications for services or questions, unless strictly necessary. This applies equally to special and/or judicial data pursuant to Arts. 9 and 10 of Regulation (EU) 679/2016.

  1. LEGAL BASIS AND LAWFULNESS OF PROCESSING

The Organisation identifies and specifies the lawfulness and legal basis of the Processing below:

  1. For the purposes referred to in Point 4. Letter a) of this statement, the Processing of your Personal Data is possible only and exclusively with your specific consent (Art. 6, Paragraph 1, Letter a) of the Regulation). The explicit and voluntary sending of electronic mail to the email addresses provided on this website represents implicit consent.
  1. PROCESSING METHODS

All Processing involves the adoption of adequate security, technical, and organisational measures for the Processing as described in Art. 32 of the Regulation. All data are processed using computer systems and possibly also by means of hard copy databases. A wide range of technologies and advanced security procedures are applied to help protect your Personal Data from the risks described above. 

  1. RECIPIENTS OF THE PROCESSED PERSONAL DATA

The recipients of Personal Data for the purposes set out above will be solely and exclusively the Data Controllers of the undersigned Organisation, and employees and direct collaborators of the Organisation, for the sole purpose of performing the services requested by Users, unless said communication is required by law or is strictly necessary for the fulfilment of the requests of the User in question. 

In order to correctly manage the service, the processing connected with the web services of these domains takes place through the company Tunda IT S. r. l. , a sole-member company – via Caldera, 21 Milano – VAT/Tax Code no. 08227280966, which provides the hosting service and guarantees the application of all security measures, pursuant to Art. 32 of the Regulation, necessary for the protection of the data in question. 

  1. TRANSFER OF DATA TO A THIRD STATE

There is no provision for the transfer of your data to a third state or to an international organisation outside the European Union (Articles 44-49 of the Regulation). The data centre where the data are stored is in Italy, at Via Caldera 21, Milan.

  1. PERIOD OF STORAGE OF PERSONAL DATA

Personal Data are not stored for longer than the time necessary to achieve the purposes of the specific data Processing described herein, save cases in which longer or shorter storage periods are required under the laws in force.

  1. For the purposes of the Processing indicated in point 4, Letter a) of this statement, and only with your specific consent, your Personal Data will be retained for the duration of any service requested or the resulting contractual relationship. In the event that a contact leads to a formal contractual relationship, your data will be retained as required by the laws and regulations in force regarding accounting, tax, and administrative records, and working relationships in general. 
  1. THE RIGHTS OF DATA SUBJECTS

You have the right to ask the Data Controller for access, cancellation, communication, updating, rectification, opposition to processing, integration, limitation, portability, and knowledge of any violation of your Personal Data. You may also exercise in general all rights provided for in Art. 13 et seq. of EU Regulation 679/2016.

  1. RIGHT TO WITHDRAW CONSENT

You have the right to withdraw consent for the Processing of your Personal Data referred to in Point 4, Letters a) to c) of this statement at any time by contacting info@zecchetti.it directly, save cases in which, subsequent to requests from you for information or your submission of a Curriculum Vitae, contractual and/or employment relationships have been established. In such cases, the right of withdrawal will be subject to legal, regulatory, and contractual obligations.

  1. SUPERVISORY AUTHORITY

You have the right to lodge a complaint with the competent control authority, the ‘Italian Privacy Authority’, if you believe that your Personal Data protection rights are at risk. 

  1. INCIDENTAL CONSEQUENCES OF REFUSAL TO REPLY

In relation to the aforementioned purpose referred to in Paragraph 4., Letter a) of this statement, the provision of Personal Data by the User is NOT ‘mandatory’, but voluntary (e.g. information requested when using the ‘CONTACTS’ service).

  1. AUTOMATED DECISION-MAKING PROCESS

Your data will not be included within any automated decision-making process. 

  1. SOCIAL MEDIA BUTTONS

The Data Controller includes social media buttons on this website. Social media buttons are digital pushbuttons directly linked to the social media platforms configured for each individual ‘button’. Clicking on these links enables direct interaction with the accounts (social media pages) of the Data Controller. The managers of the social media networks to which the buttons are linked are autonomous data controllers for Personal Data Processing. Information about the individual privacy policies of the social media platforms and how to manage and disable the relevant cookies can be found on the individual social media websites.

  1. COOKIES

Cookies are small text files that serve as IT markers and they are sent by servers (in this case, the Site server) to user devices (generally an Internet browser) when Users access a given website page.   1. TECHNICAL AND FUNCTIONAL COOKIES: these facilitate navigation on the Site/APP and the use of its functions. Technical cookies include essential cookies, also referred to as ‘strictly necessary’, without which it is impossible to use all features of the Site/APP, and performance cookies which improve the functionality of the Site/APP.

The Italian Privacy Authority defines technical cookies as: those used for the sole purpose of “transmitting a communication over an electronic communications network, or to the extent strictly necessary to the provider of an information society service explicitly requested by the subscriber or User to provide a service”.

  1. NO PROFILING COOKIES
  2. THIRD-PARTY COOKIES: Third-party cookies belong to different domains from the one shown in the address bar. These types of cookies generally appear when web pages include content from external web sites, such as advertising banners. They are used to provide additional services and features to visitors and improve the use of the site itself, e.g. social media buttons. This privacy policy does not apply to services provided by third parties and this website has no control over their cookies.

Run the Chrome Browser.

Click on the menu in the browser toolbar next to the url navigation address window.

Run the Mozilla Firefox Browser.

Click on the menu in the browser toolbar next to the url navigation address window.

Select Options.

Select the Privacy panel.

Click Show Advanced Settings.

In the ‘Privacy’ section, click on the ‘Content Settings’ button.

In the ‘Tracking’ section the following cookie options are available:
